Fair Use Policy

Effective date: September 11, 2025

This policy keeps Axofy fast, fair, and safe for everyone. It covers how you use the product, the resources you consume, and how you handle third-party content and rights.

The short version

Use Axofy to create your own ads and UGC videos. Respect laws and platform rules. Don’t try to get around limits. Don’t infringe others’ IP. If usage harms service quality or breaks these rules, we may throttle, suspend, or terminate access.

1) Purpose

  • Protect service quality for all users

  • Set clear rules for acceptable use, resource consumption, and IP handling

  • Explain how we respond to abuse

2) What “fair use” means here

  • Fair to other users: your usage stays within plan limits and doesn’t degrade the service

  • Fair to rights holders: you own or have rights to everything you upload and don’t misuse others’ IP

  • Fair to platforms: your outputs follow the ad network and marketplace policies where you publish

3) Permitted use

  • Create UGC videos for your brand, clients, or internal projects

  • Upload assets you own or are licensed to use

  • Export in the formats and aspect ratios supported by Axofy

4) Prohibited use

  • Illegal or harmful content: anything unlawful, deceptive, defamatory, hateful, or designed to harass or incite harm

  • IP violations: using trademarks, logos, brand names, music, images, or footage without proper rights

  • Impersonation: pretending to be a person or brand without authorization

  • Security abuse: scraping, automated access, bypassing technical protections, reverse engineering, or interfering with service integrity

  • Circumventing limits: creating multiple accounts or using tools to dodge quotas, rate limits, or billing

  • High-risk uses: medical, legal, or financial claims presented as facts without required approvals and disclaimers

  • Spam: mass-generated or misleading content aimed at gaming platforms or deceiving users

5) Resource and rate limits

  • Your plan defines render minutes, storage, exports, and concurrency

  • We may throttle heavy or abnormal usage to protect stability

  • Long-running or stuck jobs may be auto-canceled to free capacity

  • Fair use includes reasonable experimentation, not job flooding

6) Content rights and attribution

  • You own the assets you upload and the outputs we render for you

  • You’re responsible for licenses, model releases, music rights, fonts, and any third-party elements in your project

  • If you use a brand name, logo, or product imagery, ensure you have permission or a defensible legal basis

  • When platforms require disclosures (sponsored, paid partnership, AI-generated), follow their rules

7) AI and third-party services

  • We may use infrastructure or AI vendors to process your content

  • We do not train on your projects or outputs

  • Vendor use is contract-restricted to service delivery where such options exist

  • Subtitles are available only for URL-to-UGC as documented

8) Accuracy and claims

  • Axofy helps you produce videos; you are responsible for accuracy, claims, and compliance with ad policies and local law

  • Review outputs before publishing

9) Security and abuse response

  • We monitor for abuse, fraud, and service degradation

  • We may warn, throttle, suspend, or terminate accounts that violate this policy

  • Critical risks (malware distribution, widespread IP abuse, platform evasion) may lead to immediate suspension

10) Takedowns and disputes

  • If we receive a credible IP or policy complaint, we may pause access to specific assets or outputs while we review

  • Provide proof of rights when requested

  • Copyright issues: takedown@axofy.ai (include details and links)

11) Data retention

  • When you delete a project, it leaves active systems within 30 days, backups within 90 days

  • Logs and diagnostics are kept 30–90 days unless needed longer for security or legal reasons

12) Region and platform rules

  • Laws differ by region; you’re responsible for local compliance, including consumer protection and advertising rules

  • Respect platform-specific ad and content policies (Meta, Google, TikTok, X, Amazon, etc.)

13) Changes

  • We may update this policy to protect the service; we’ll update the date above and, for material changes, notify you in-app or by email

15) Practical checklist (use this before you export)

  • Do I own or have rights to every asset in this project?

  • Does the script avoid unsupported claims and follow the ad platform’s rules?

  • Is my usage within plan limits, and are renders not blocking others?

  • Do I need disclosures (sponsored, AI-assisted, paid partnership)?

  • Am I publishing in regions where this content and offer are compliant?

If the answer to any of these is “not sure,” fix it before you export.
